1. Scope of Service
DomuCare ("DomuCare", "we") operates a software platform (Software-as-a-Service) that connects qualified caregivers with families seeking home care in Austria. Important: DomuCare is a purely technical software provider, not a placement agency, employer, or care provider. We provide the digital tools — AI-powered matching, scheduling, secure payment processing, and contract management — that enable caregivers and families to find each other and enter into direct contractual relationships. The care agreement is concluded directly between the caregiver and the family. DomuCare is not a party to this agreement and has no role in the employment, supervision, or direction of care services. Caregivers are independent contractors who set their own rates and terms.
2. Account Obligations
By creating an account, you agree to: • Provide accurate and complete information in your profile • Keep your account credentials secure and not share them with third parties • Notify us promptly of any unauthorised access to your account • Maintain only one account per person • Be at least 18 years of age We reserve the right to suspend or terminate accounts that violate these obligations or our policies.
3. Pricing & Payments
DomuCare uses a transparent daily pricing model: For Families: DomuCare charges a flat daily platform fee of €8 per day (approximately €240 per month, billed monthly) for access to the software platform, including AI-powered matching, contract management, scheduling, and secure payment processing. This fee is separate from the caregiver's rate. A one-time placement fee of €50 is charged per caregiver placement. The caregiver sets their own daily rate (typically €75 to €90 per day). 100% of the caregiver's rate goes directly to the caregiver — DomuCare does not take any commission or cut from the caregiver's earnings. Your total cost per day is the sum of the caregiver's rate plus the platform fee (typically €83 to €98 per day). For Caregivers: Using DomuCare is free. There are no subscription fees, placement fees, or commissions. You set your own rate and receive 100% of your earnings directly from the family. Payments are processed via SEPA direct debit or credit card through Stripe. All prices include applicable VAT. The family's platform subscription renews automatically each month. You may cancel at any time; cancellation takes effect at the end of the current billing period. No refunds are provided for partial months.
4. Matching Process
Our AI-powered matching software connects caregivers with families based on language skills, qualifications, care needs, availability, and personal preferences. • We strive to provide suitable matches but do not guarantee a specific caregiver or placement outcome • Both parties must mutually agree before entering into a direct care agreement • Either party may decline a proposed match without penalty • We verify caregiver qualifications and certifications but families are encouraged to conduct their own assessment DomuCare facilitates the introduction only. The decision to enter into a care arrangement and the terms of that arrangement are solely between the caregiver and the family.
5. User Content & Conduct
You are responsible for all content you submit to the platform, including profile information, messages, and uploaded documents. You agree not to: • Submit false, misleading, or fraudulent information • Use the platform for purposes other than care placement • Harass, threaten, or discriminate against other users • Attempt to circumvent the platform to avoid subscription fees • Upload malicious software or content that infringes third-party rights We may remove content and suspend accounts that violate these terms.
6. Limitation of Liability
DomuCare provides software tools only and does not act as an employer, agency, or care provider. To the extent permitted by law: • We are not liable for the quality, safety, or legality of care services provided by caregivers • We are not liable for any disputes between caregivers and families arising from their direct contractual relationship • We are not liable for indirect, incidental, or consequential damages arising from use of the platform • Our total liability is limited to the platform fees paid by you in the 12 months preceding the claim Nothing in these terms limits liability for wilful misconduct, gross negligence, or liability that cannot be excluded under Austrian law.
7. Termination
You may terminate your account at any time by contacting us or through the platform settings. We may terminate or suspend your account if: • You breach these terms of service • You fail to pay subscription fees after reasonable notice • Your account has been inactive for more than 12 months • Continued use of the platform poses a risk to other users Upon termination, your access to the platform will be revoked. Data retention follows our Privacy Policy.
8. Changes to Terms
We may update these terms from time to time. We will notify you of material changes via email or through the platform at least 30 days before they take effect. Continued use of the platform after the effective date of changes constitutes acceptance of the updated terms. If you do not agree with the changes, you may terminate your account before the effective date.
9. Governing Law & Jurisdiction
These terms are governed by the laws of the Republic of Austria, excluding its conflict of laws provisions. Any disputes arising from or relating to these terms or the use of the platform shall be subject to the exclusive jurisdiction of the competent courts of Vienna, Austria. For consumers within the EU, mandatory consumer protection provisions of their country of residence apply in addition to the above.
